How McDowell Release Dates Differ

The most important West Virginia calculation quirk is terminology. WVDCR uses Minimum Discharge Date/Final Release Date for its conditional custody calculation. The Parole Board uses PED for the first date on which parole may be considered. A PED is not a promise, and section 62-12-13a says eligibility does not create a right to release. Regional-jail parole grants need extra care. The Board FAQ says a person granted parole from a regional jail first transfers to a WVDCR facility for intake and fingerprinting. It advises expecting about seven to ten days before actual parole release. Thus a McDowell detainee can leave SWRJCF and remain in state custody during that process. The release record must state the destination, not just the fact that the person left one facility.

MDD also differs from discharge after parole. Someone may leave prison before MDD on a valid grant, then remain under Welch Parole Office supervision until a later discharge. McDowell Good-Time Release Rules

West Virginia does not apply a blanket 85-percent truth-in-sentencing rule. Under West Virginia Code §15A-4-17, each eligible inmate committed to WVDCR receives one day of good time for each day physically incarcerated. Eligible credited presentence jail days count. Consecutive terms are aggregated for the calculation even though individual sentences remain listed on the time sheet. Disciplinary good time may be forfeited and sometimes restored. WVDCR policy also recognizes discretionary extra good time for qualifying service or duties during a declared emergency.
