A booking photograph records appearance during a particular intake. It does not show the later case outcome, prove guilt, or establish that a person reached the community. In McDowell County, the source depends on the custody path. The McDowell County released-inmate record path supplies the custody and court checks needed to interpret the image. A name disappearing from jail OIS remains only a lead because it can reflect release, transfer, court movement, data lag, or another custodian.

- For a sheriff-created image, call 304-436-8523 or the desk at 304-436-8525 to confirm the current written request channel.
- Request an electronic copy, exclude protected information, and ask for segregable nonexempt portions.
- Ask for reproduction cost before it is incurred and request a written reason if the image is withheld.
Under West Virginia FOIA §29B-1-3, a custodian must respond within at most five days, excluding weekends and legal holidays, by furnishing copies, setting an inspection time, or denying in writing with reasons. This is a response framework, not a promise of complete production in five calendar days. Fees may cover actual reproduction cost, not search or staff time. No general WVDCR or McDowell booking-photo fee schedule was found.
The request can also seek a narrow release event: admission date, actual release date and time, facility, authority or disposition, and destination category. Pairing those fields with the image gives the photograph its proper custody context without demanding a full confidential offender file.
Avoid the Wrong McDowell Mugshot App
Search engines and app stores prominently return a “McDowell County Sheriff” inmate app, but it belongs to McDowell County, North Carolina. It is not an official source for McDowell County, West Virginia releases or mugshots. No official West Virginia county app offering a release list, inmate search, or booking-photo archive was located in the dated research sweep. This same-name false positive can place the wrong person, state, and agency into a search.
Confirm the state before entering a name. The official McDowell County, West Virginia directory lists county contacts, while WVDCR supplies the regional-jail and prison systems. SWRJCF is in Holden, Logan County, even though it serves McDowell arrests. Stevens and FCI McDowell sit within McDowell County but belong to state and federal systems. Geography alone does not identify the correct photo custodian.
A genuine West Virginia mobile or web result should name the agency and facility that supplied the photo. If the source cannot be tied to WVDCR, the sheriff, a court, or another official record, treat the image as unverified. Do not let an app icon or county name replace source checking.
McDowell Prison and Registry Photos
A state-prison photo is distinct from a county-arrest booking image. The official WVDCR prison search is the right starting point for a person sentenced into state correctional custody, including a person housed at Stevens. A live result must establish whether a photo is shown and what the status and date labels mean. Automated access to that application was blocked during research, so no claim should be made that every discharged offender remains searchable or that all results retain a photograph.
The West Virginia State Police registry is still narrower. It covers only people who have a legal duty to register. An image there may be a registry image rather than the original booking photograph, and the listing cannot supply a general McDowell release date. The official disclaimer also warns that information may await verification or change. A registry result should never be expanded beyond the registration record it reports.

McDowell Released Photos in News
Official agency notices and local news can carry an arrest photo when an event drew public attention. Those items are episodic. They often describe the arrest stage and may predate bond, dismissal, sentencing, transfer, release, or expungement. Date-stamp the article or post, identify the agency credited for the image, and check the later court docket and custody record before attaching a present-tense meaning to it.
Secondary photo collections may copy an old image, omit corrections, join two people with similar names, or preserve a charge after the legal outcome changed. They belong at the bottom of the evidence hierarchy. No commercial mugshot publisher or removal vendor should be treated as the primary source. An official agency file with matching identifiers is stronger, while a signed court order supplies the disposition and an institutional record supplies the actual release event.
Name-only matching is especially weak. Compare a lawful date of birth, booking or offender number, case number, facility, sentencing county, and event date. If the records cannot be joined with confidence, keep them separate. A clear statement that an image could not be authenticated is more accurate than forcing a match.
McDowell Mugshot Removal Law
West Virginia Code §62-1-6a has a narrow scope. It governs certain law-enforcement use of booking photographs on social media. Covered agencies generally may not post the photo of a person arrested for a defined minor offense unless a conviction, fugitive or imminent-threat reason, or court order supplies an exception. WVDCR and its subordinate organizations are excluded from the definition used in this statute. The law is not a blanket rule that all mugshots are public, private, sealed, or removable from every site.
The statute also creates a request-based removal route for a covered agency’s social-media page after listed favorable outcomes. These include dismissal, a grand jury’s decision not to indict, acquittal, or a conviction later reversed, vacated, or nullified. The subject or representative must request removal. The covered agency then has 14 days after that request. This is not an automatic deadline that begins on arrest or case outcome, and it does not control a separate copy held elsewhere.

No enacted commercial pay-to-remove clause was found in the current section. Proposed text must not be stated as law. Separately, West Virginia expungement statutes may restrict a qualifying court record after dismissal, acquittal, or certain convictions, subject to exclusions and waiting periods. Expungement does not by itself prove that every copied photo vanished. Obtain the order and direct a request to the official custodian that controls the image.
